In another case among cases that are rising in online purchases, District consumer forum Indore - 2 ordered a national mobile company to refund the amount of defective mobile purchased online and also pays compensation to complainant. In all, the company was asked to pay Rs 11,500.
The details of the case were shared by advocate Manish Zarola. Zarola shared, “The plaintiff had purchased a mobile phone (Panasonic Eluga Ray X) online considering the reasonable pricing.”
The mobile phone was purchased for Rs 6,999. After working a couple of days, the mobile had technical issues like hanging and others.
“It was a newly purchased mobile sold as new, which should not suffer from technical issues,” Zarola said. Bothered by the problem, the plaintiff approached the online retailer and asked to refund the amount.
The selling company through the online portal refused to refund the amount or accept the claim. Bothered by the issue, plaintiff found no way to send any other complaints and get back his investment.
Approaching the consumer forum bench of president Om Prakash Sharma and member Atul Jain, the plaintiff presented the case through advocate.
After considering the complaint, the bench found mobile company at fault and ordered to refund the purchase amount of Rs 6,999. Further, the company was ordered to pay compensation of Rs 3,000 to the plaintiff.
Consumer forum charges to be paid to advocate of Rs 1,500 are also to be cleared by the mobile company.
